Terms of Service

1. Acceptance of Terms

By accessing and using Biomimic's lead generation platform ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Service Description

Biomimic provides AI-powered lead generation services through social network advertising platforms. Our service includes:

• Lead discovery and qualification using artificial intelligence
• Social media advertising campaign management
• Lead delivery and analytics reporting
• Campaign optimization and performance monitoring

3. Pricing and Payment Terms

Our pricing structure is based on qualified leads delivered:

• Facebook & Instagram campaigns: $40 per qualified lead
• LinkedIn Premium campaigns: $50 per qualified lead
• Google & YouTube campaigns: $60 per qualified lead

Payment is due within 30 days of invoice date. We reserve the right to suspend services for overdue accounts.

4. Lead Qualification Standards

A "qualified lead" is defined as a prospect who:

• Meets your specified demographic and psychographic criteria
• Has shown genuine interest in your product or service
• Provides accurate and verifiable contact information
• Has the authority and budget to make purchasing decisions
• Responds to initial contact attempts within 72 hours

5. Client Responsibilities

As a client, you agree to:

• Provide accurate information about your target audience and business
• Respond to qualified leads in a timely and professional manner
• Comply with all applicable laws and regulations in your industry
• Maintain professional communication standards with prospects
• Provide feedback on lead quality to help improve our service
• Pay invoices within the specified timeframe

6. Service Limitations

While we strive to deliver high-quality leads, we cannot guarantee:

• Specific conversion rates or sales outcomes
• Lead volume within specific timeframes
• Availability of leads in all industries or geographic regions
• Continuous service availability due to platform maintenance

7. Intellectual Property

All proprietary technology, algorithms, and methodologies used in our lead generation platform remain the exclusive property of Biomimic. Clients may not reverse engineer, copy, or distribute our technology.

8. Privacy and Data Protection

We are committed to protecting the privacy of all leads and client data. Our data handling practices are detailed in our Privacy Policy. By using our service, you agree to our data collection and processing practices.

9. Termination

Either party may terminate this agreement with 30 days written notice. Upon termination:

• All outstanding invoices become immediately due
• Access to our platform will be discontinued
• Lead delivery will cease
• Client data will be securely deleted within 90 days

10. Limitation of Liability

Biomimic's liability is limited to the amount paid by the client in the 12 months preceding any claim. We are not liable for indirect, consequential, or punitive damages arising from the use of our service.

11. Governing Law

This agreement is governed by the laws of Arizona, United States. Any disputes will be resolved through binding arbitration in Tucson, Arizona.
